The Binding Nature of These Terms

By merely visiting this site, or engaging in a transaction with us, you are implicitly consenting to these Terms of Service. Should you find these terms disagreeable, you are not authorized to use this site or avail yourself of any services we offer. To put it plainly: If you don't agree, don't use the site.

Scope and Applicability

These Terms are not a one-time agreement but apply universally to all users and all interactions with this site. They also encompass any additional policies or terms made available via hyperlink. Moreover, any updates, new features, or tools added to the current store will likewise fall under the purview of these Terms.

The Dynamic Nature of These Terms

The Platform

We must also disclose that our e-commerce capabilities are facilitated by Squarespace, who provide the technological platform through which we offer our products and services to you.

You can use this site only if you've reached the age of majority in your jurisdiction. If you're a minor but have parental consent, that works too. Don't even think about using our products for illegal activities or to infringe on copyright laws. Transmitting malicious code is also out of bounds. We're under no obligation to serve anyone and can refuse service at our discretion. Keep in mind, your data—except for your credit card information—may be transferred without encryption and may be adapted to meet technical requirements. Your credit card details will always be encrypted. You don't have the right to exploit any part of this service without our explicit written approval. The headings in this document? They're just for your convenience and don't affect the interpretation of these terms.

We offer no guarantees on the accuracy or completeness of information on this site. It's your responsibility to validate the information before acting upon it. This site may contain historical data, which is offered for your reference and should not be considered current. We can change the site's content at our discretion but have no obligation to update it.

Section 4 - Service and Price Changes

The price tags on our products can change without prior notice. We can also alter or suspend our services at our will. Don't hold us accountable for any modifications or your inability to access the services thereafter.

Section 5 - Products, Services, Quality, and Restrictions

Some products or services are exclusively online and may have limited quantities. Returns are processed according to our Return Policy. We aim for accuracy in product images and colors, but can't guarantee that your device will display them correctly. We reserve the right to limit sales and product quantities at our discretion. We make no warranties about the quality of our products or services.

Section 6 — Ownership of Media, Copyright, and Archival Rights

6.1 Creator Ownership
All photographs, videos, 360 media, drone footage, RAW files, HDR brackets, LOG video, digital negatives, and any other creative or technical media captured by Lefties Lens Limited (collectively, the “Media”) are and will remain the sole and exclusive property of Lefties Lens Limited. No rights, title, or ownership in the Media are transferred to you at any time.

6.2 Client License
Upon full payment, you receive a limited, non-exclusive, non-transferable license to use the delivered, edited Media solely for marketing the specific real estate listing for which the Media was commissioned. This license does not include any rights to the RAW files, unedited footage, derivative works, or any future or alternative uses unless expressly granted in writing.

6.3 Exclusions from License
You are not authorized to:
• claim copyright or ownership over the Media
• resell, sublicense, or redistribute the Media
• use the Media for any purpose other than marketing the active listing
• request or compel delivery of RAW files or original captures
• alter, train, or use the Media in any form of machine learning, AI development, dataset creation, or computational modeling without explicit written permission

6.4 Archival Rights and Long-Term Data Retention
Lefties Lens Limited retains the unrestricted right to store, archive, catalog, and utilize all Media for:
• portfolio and marketing purposes
• internal quality control
• training and development of creative or technical workflows
• future commercial licensing
• inclusion in curated collections
• sale, assignment, or transfer of the Media as part of a business asset transaction
• use in data licensing arrangements, including but not limited to training of machine learning, AI, computer vision, or spatial computing systems

No client consent beyond acceptance of these Terms is required for this archival or commercial use, provided that no personally identifiable information or sensitive personal content is present in the Media. Real estate interiors, empty rooms, property details, and architectural features are not considered personal data.

6.5 Privacy and Legal Compliance
The Media captured consists solely of real estate interiors, exterior property views, and architectural or environmental features. You acknowledge that this Media does not constitute personal information under applicable privacy laws, and you grant permission for the capture and retention of this Media as part of commissioning our services.

6.6 No Work-Made-For-Hire
All Media created by Lefties Lens Limited is expressly not work made for hire. No implied ownership or joint authorship is created through payment, booking, or participation in a photo or video session.

6.7 Irrevocable Rights
Your license to use the edited Media may expire upon sale of the property, but our ownership rights, archival rights, and commercialization rights are irrevocable, perpetual, and worldwide.

6.8 Survival of Rights
All ownership and archival rights survive termination of services, project completion, or cessation of business operations.

Section 7 - Photography Releases

You're responsible for obtaining any necessary releases or permissions for photographed properties. You'll also defend and indemnify us against any claims arising from your failure to obtain such releases.

Section 8 - File Maintenance and Loss

We'll keep digital negatives for up to six months and JPGs for a year. We are not liable for replacing lost, corrupted, or damaged files after a specific time period.

Section 9 - Property Accessibility and Safety

You must ensure a hazard-free environment for our photographers. Failure to do so may result in the cancellation of services, and you'll still be liable for all fees.

Section 10 - No Harassment

Harassment or threats against our staff will not be tolerated and may result in immediate termination of services. You're responsible for all fees in such cases.

Section 11 - Billing and Account Information

We have the right to refuse or limit orders. You must provide accurate and current information for all transactions.

Section 12 - Optional Tools

We may offer third-party tools "as is" and without warranties. We're not liable for your use of these tools.

Section 13 - Third-Party Links

We're not responsible for third-party websites linked on our site.

Section 14 - User Comments and Submissions

We may use your comments and suggestions at our discretion. We're not obligated to keep them confidential or offer compensation.
